1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Onramp Consulting LLC, a limited liability company organized in Colorado, United States ("ForwardWins," "we," "our," or "us"), which operates the ForwardWins app at forwardwins.app and the site at forwardwins.com (together, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Cancellation Policy, which are part of these Terms by reference. If you do not agree, please do not use the Service.
2. Who may use the Service
You may use ForwardWins only if you can form a binding contract with us and you are at least 13 years old. If you are between 13 and 18 (or the age of majority where you live), you may use the Service only with the permission and supervision of a parent or guardian who agrees to these Terms on your behalf, and only that parent or guardian may buy a paid subscription or enter payment information. By using the Service you represent that you meet these requirements and that the information you give us is accurate.
3. Your account and passwordless sign-in
ForwardWins uses passwordless sign-in. When you sign in, we email you a single-use magic link or a 6-digit code that expires after a short time. There is no password to create or remember. Because sign-in runs through your email, you are responsible for keeping your email account secure and for all activity that happens under your account. Tell us promptly at info@forwardwins.com if you think someone has gained access to your account without permission. You may not share your account in a way that violates these Terms.
4. The Service and your license to use it
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use ForwardWins for your own personal, non-commercial goal setting and habit building, subject to these Terms. We may add, change, or remove features, plans, and content over time as we improve the Service.
5. Plans, pricing, billing, and automatic renewal
Please read this section carefully. It describes a subscription that renews and charges automatically until you cancel.
Free plan. ForwardWins offers a free plan that does not require a card. You can use it for as long as you like within the limits we set for that plan.
Full Access plan. Full Access costs $1.00 for your first month, then $12.00 per month after that. Payment is processed on the web by Stripe. When you subscribe, you expressly authorize us and Stripe to charge your payment method $1.00 today and then $12.00 per month automatically, on a recurring basis, starting on your renewal date and each month after, until you cancel. Your renewal date is shown to you at signup, on your receipt, and in App Settings.
Express consent. Before you pay, we show you all of the material terms (the price now, the price and cadence going forward, the renewal date, and how to cancel) right next to an unchecked consent box, and we charge you only after you tick that box and start the plan. We do not pre-check consent, and we do not bury these terms.
Receipts and reminders. We email you a receipt after each charge that restates the renewal terms and how to cancel. Where required by law, and as our standard practice, we also send reminder notices before your introductory month converts to the recurring price and on a periodic basis for continuing subscriptions.
Price changes. We may change our prices. If we change the price of your plan, we will give you advance notice by email and, where the law requires, ask for your renewed consent, so you can decide whether to continue before the new price applies.
Taxes. Prices may not include sales tax, VAT, GST, or similar taxes. Where we are required to collect them, they will be added and shown at checkout or on your receipt.
Failed payments. If a charge fails, we may retry it, and we may pause or end your Full Access until payment succeeds. Your account can drop to the free plan if payment is not completed.
Currency. Charges are in US dollars unless we say otherwise at checkout.
6. Cancellation and refunds
You can cancel Full Access at any time in one tap from App Settings. Cancellation stops future charges. Your Full Access continues until the end of the period you have paid for, then your account moves to the free plan. We do not give refunds for a subscription month that has already started, and we do not prorate partial months, except where a refund is required by law. We keep this fair by charging only $1 for your first month, showing your renewal date plainly, and making cancellation a single tap with no phone calls and no retention maze. Nothing in these Terms limits any non-waivable statutory refund, withdrawal, or cancellation right you may have where you live. 7. Your content
You own your content. The goals, mountains, habits, notes, check-ins, and other material you create in ForwardWins ("Your Content") belong to you. We do not claim ownership of it. You grant us a limited, worldwide, royalty-free license to host, store, back up, reproduce, and display Your Content, and to process it, only as needed to operate, secure, and improve the Service and to provide it back to you. This license ends when you delete Your Content or your account, except for copies kept in routine backups for a limited time or as required by law. You are responsible for Your Content and for having the right to use it. Please do not enter sensitive personal, medical, or financial-account information into your goal content.
8. Acceptable use
When you use ForwardWins, you agree not to: break the law or use the Service for any unlawful, harmful, or fraudulent purpose; upload or share content that is illegal, infringing, harassing, hateful, or that violates someone's rights or privacy; try to access accounts, data, or systems that are not yours; probe, scan, disrupt, overload, or interfere with the Service or its security; reverse engineer, decompile, scrape, or copy the Service or its underlying code except where the law expressly allows it; resell, sublicense, or commercially exploit the Service without our written permission; or use the Service to build a competing product or to train a machine learning model on our content without our written permission. We may investigate and take action, including suspending or ending your account, if you break these rules.
9. Our intellectual property
The Service, including the ForwardWins name and logo, the mountain method, the yeti mascot, the Summit Passport, the software, designs, text, graphics, and other content we provide (but not Your Content), is owned by us or our licensors and is protected by intellectual property laws. "ForwardWins" and related marks and logos are our trademarks, and you may not use them without our written permission. We keep all rights we do not expressly grant you. If you send us ideas or suggestions, you grant us a perpetual, royalty-free right to use them without any obligation to you.
10. Third-party services
The Service relies on third parties, such as Stripe for payments, Resend for email delivery, Netlify for hosting, Google Analytics for usage analytics, and Anthropic (accessed through the Netlify AI Gateway) to power the AI helper features. Your use of those services may be subject to their own terms, and we are not responsible for them. Stripe's handling of your payment information is governed by Stripe's terms and privacy policy.
11. ForwardWins is not medical or professional advice
ForwardWins is a productivity, goal, and habit tool designed to be kind and encouraging. It is not a medical device, and it does not provide medical, psychological, therapeutic, financial, legal, or other professional advice, diagnosis, or treatment. It is not a substitute for care from a qualified professional. Content in the app, including anything that references executive function, focus, overwhelm, or wellbeing, is for general informational and self-organization purposes only. Always seek the advice of a qualified professional for questions about a medical or mental-health condition, and never disregard professional advice or delay seeking it because of something in the Service. If you may be in crisis, contact your local emergency services or a crisis line. Some features use AI to help break goals into steps, shorten a step, or name a sidequest. AI suggestions are generated automatically, may be inaccurate, incomplete, or unsuitable for your situation, and are ideas for you to review and edit, not advice or instructions to follow. You decide what to keep and what to act on. Your use of the Service is your own decision and responsibility.
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your expectations or produce any particular result. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, ForwardWins and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the total amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you, and nothing here limits liability that cannot be limited by law.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless ForwardWins and its owners, employees, and providers from any claims, damages, losses, and reasonable legal fees arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. This section does not apply to the extent a claim results from our own wrongdoing.
15. Suspension and termination
You can stop using the Service at any time and can delete your account in App Settings. We may suspend or end your access to the Service, with or without notice, if you violate these Terms, if we are required to by law, or if we reasonably believe it is needed to protect the Service or other users. If we end your account without cause, we will not charge you for periods after termination. Sections that by their nature should survive termination (such as content licenses you granted, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
16. Changes to the Service and to these Terms
We may change the Service, and we may update these Terms. Changes take effect when we post the updated Terms and change the "Last updated" date. When we make material changes, we will make reasonable efforts to let you know, such as an in-app message or email, but your continued use of the Service after an update means you accept the updated Terms. If you do not agree, please stop using the Service and cancel any paid plan.
17. Governing law and dispute resolution
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules, except where the mandatory consumer-protection laws of your home country or state give you additional rights that cannot be waived. You and we agree that any dispute will be resolved exclusively in the state or federal courts located in Williamson County, Tennessee, and each party consents to the personal jurisdiction and venue of those courts. Before starting any formal proceeding, please contact us at info@forwardwins.com so we can try to resolve the matter. Either party may bring a claim in small claims court if it qualifies. Consumers in the EU, EEA, and UK keep the right to bring proceedings in their home courts and to rely on the mandatory consumer protections of their country.
18. General terms
These Terms, the Privacy Policy, and the Cancellation Policy are the entire agreement between you and us about the Service and replace any earlier agreements on the subject. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right, that is not a waiver of it. You may not assign these Terms without our consent; we may assign them, for example in a merger or sale of our business. We are not responsible for delays or failures caused by events beyond our reasonable control. We may send you notices by email or in the app, and you can send us notices at info@forwardwins.com.
